PlanningandZoningCommissionRegularMeeting <br />July16,2015 <br />LegacyatLaPorteSCUP <br />compatibilitywiththeresidentialnatureofthevicinity.Althoughthisdevelopmentis <br />notsubjecttotheĭźƷǤƭdesignguidelinesasoutlinedinArticleIXofChapter106,staffis <br />recommendingthattherequirementsofaTier2developmentbeincorporatedintothe <br />design.OnesuchrequirementofTier2developmentincludestheuseof50%stoneor <br />masonryand50%ofothermasonrymaterialsincludingstuccoandcementitious <br />fiberboard.AllotherTier2designstandardsshallbeapplicabletothisdevelopmentas <br />well. <br />ProximitytoExistingMultifamilyDevelopment. <br />TheFairmontOaksapartmentcommunityislocatedacrossUnderwoodRoadfromthe <br />proposedLegacydevelopment.Section106333,Footnote10,statesthatmultifamily <br />developmentof50ormoreunitsmustbelocatedatleast1,000feetfromother <br />multifamilyresidentialdevelopment.Inthiscase,thepropertylinesofthetwo <br />apartmentcommunitieswouldbeseparatedbytheЊЉЉwideUnderwoodRoadright <br />ofway.Thisdeviationtothecoderequirementscanonlybeapprovedthroughapproval <br />ofavariancebytheBoardofAdjustment.Asaresult,staffisrecommendingthata <br />conditionbeincludedintheSCUPrequiringapplicationforavariancebeapprovedby <br />theBoardbeforethisordinancegoesintoeffect.ShouldtheBoarddenythevariance, <br />thentheSCUPwillnotgointoeffect. <br />SiteAccess. <br />Theconceptualsiteplanidentifiesthreeaccesspointstothesite:themainaccesspoint <br />fromUnderwoodRoad;asecondaccesspointonCaniffRoad;andathirdemergency <br />onlyaccesspointtoaprivateaccessdrivetothesouthofthesite.Staffhassome <br />concernabouttheCaniffRoadaccesspointandthepotentialforanincreaseintraffic <br />exitingthissiteandtravelingwestonCaniffandcuttingthroughasinglefamily <br />subdivision.StaffisrecommendingthattheaccesspointonCaniffRoadbea3/4 <br />movementaccess,whichmeansaleftinfromwestboundCanifftothesite,arightin <br />fromCaniffeastboundtothesite,andarightonlyfromthesiteontoeastbound <br />Caniff.StaffrecommendsthatnoleftturnfromthesitetowestboundCaniffbe <br />allowed.Thiswouldrequiretheapplicanttoconstructamedianandinstallsignagethat <br />woulddirecttraffictotakearightturnonlyfromthesiteonCaniff. <br />TrafficImpacts. <br />Staffisrecommendingthattheapplicantprepareatrafficimpactanalysisthatwillshow <br />thepotentialimpactsoftheproposeddevelopmentontheroadwaysinthevicinityat <br />thetimeofsiteplansubmittal.Anyrecommendationsidentifiedinthereportto <br />mitigateanynegativeimpactswillneedtobemitigatedbytheapplicant. <br />PublicUtilities. <br />Publicutilityfacilitiesandservicesaresufficienttohandletheproposeddevelopment. <br />Waterandsanitarysewerlinesarebothavailablewithinthevicinity.Howeverthe <br />5 <br /> <br />
